Purchase returns
If for any reason you decide to refuse the purchased goods, then, in accordance with the Law of the Russian Federation “On the Protection of Consumer Rights” dated 02/07/1992 No. 2300-1 (for legal entities – in accordance with the Civil Code of the Russian Federation), the return of goods is possible subject to the following conditions:
Return of goods of proper quality.
1. The Customer has the right to refuse the ordered Product at any time before receiving it, and after receiving the Product – within 7 (seven) days, not counting the day of purchase.
2. Return of a Product of proper quality is possible if its presentation, consumer properties, as well as a document confirming the fact and conditions of purchase of the specified Product are preserved.
3. The Client does not have the right to refuse a Product that has individually defined properties if the specified Product can be used exclusively by the Client purchasing it.
4. If the Customer refuses the Goods of proper quality, the Seller must return to him the amount of money paid by the consumer under the contract, with the exception of the seller’s expenses for delivery of the returned goods from the consumer, no later than 10 days from the date the consumer submits the corresponding demand.
Returning goods of inadequate quality
A product of inadequate quality means a product that is unable to provide its functional qualities due to a significant defect (with the presence of defects/defects).
The buyer to whom a product of inadequate quality is sold, unless this was agreed by the seller, has the right, at his own discretion, to declare any of the following requirements:
- replacement with a product of a similar brand (model, article) or with the same product of a different brand (model, article) with a corresponding recalculation of the purchase price;
- proportionate reduction in the purchase price;
- free elimination of defects in goods or reimbursement of costs for their correction by the buyer or a third party;
- has the right to refuse to fulfill the contract and demand a refund of the amount paid for the goods.
When returning a technically complex product of inadequate quality (the list of such goods is approved by Decree of the Government of the Russian Federation of November 10, 2011 No. 924 “On approval of the list of technically complex goods”), the Buyer has the right to demand:
- replacement with a product of a similar brand (model, article) or with the same product of a different brand (model, article) with a corresponding recalculation of the purchase price;
- refuse to fulfill the contract and demand a refund of the amount paid for the goods.
All of the above requirements for the return of goods of inadequate quality can be presented within the following deadlines:
- The product has a warranty period – during the entire warranty period;
- The product does not have a warranty period – within a reasonable period, but not more than 2 years.
The online store has the right to refuse to exchange or return the goods if it considers that the discovered significant defect is a consequence of improper use of the goods.
In case of disagreement regarding the quality or reasons for the occurrence of deficiencies, the online store has the right to conduct an independent examination at its own expense. The buyer can participate in the examination and challenge its decision in court. If, as a result of the examination, it is established that the defects of the goods arose through the fault of the Buyer, then the Buyer is obliged to reimburse the online store for the cost of the examination, as well as the associated costs of transportation and storage of the goods.
